On October 26, 2026, IT Home reported that the first comprehensive risk insurance plan for AI applications was officially launched at the 2026 Financial Street Forum. This insurance covers both third-party losses caused by AI services and financial losses for AI providers, filling a gap in the domestic AI insurance market. The policy protects against damages from AI-generated content that infringes on third-party rights or causes misleading information, potentially leading to personal injury or property loss. The insurance company evaluates risk factors such as AI usage scenarios, content generated, and data processed to determine premiums. Claims are not automatically fully covered and depend on legal responsibility and contractual terms. Additionally, insurance is available for AI service providers to cover costs related to model performance issues, such as repairs, refunds, and evaluations. This product targets AI model developers, application developers, and hardware manufacturers, with extensions to areas like office assistants and humanoid robots.
The Supreme People's Court issued guidelines in September 2026, stating that AI-generated content does not exempt service providers from liability, emphasizing that fault determines responsibility. Insurance companies conduct risk assessments based on model parameters and performance to offer differentiated pricing. The insurance aims to address legal and financial risks associated with AI deployment, ensuring accountability and coverage for both third-party and provider-related incidents.
