The Beijing Municipal Market Supervision and Administration Bureau has announced the first administrative penalty case in the AIGC sector related to the protection of business secrets. A company specializing in micro-short film translation and AI-driven multilingual film services was fined 100,000 yuan for an employee who copied and cracked the company's proprietary AI software before leaving. The employee then used the software in a new company to compete for business, violating commercial secrecy laws.
The company, based in Beijing's Chaoyang District, developed an internal AIGC commercial software that significantly reduced translation time and boosted productivity, making it a key part of its competitive advantage. The employee, a core member, copied the software and cracked its database during employment, then continued using it after leaving the company. Law enforcement used electronic data forensics to preserve evidence, including data from computers and servers, and reconstructed the employee's actions through software installation logs, database access records, and project files.
The case marked the first time that AIGC commercial software was recognized as a protected business secret under administrative law. It also demonstrated the ability of market regulators to address challenges in evidence collection through advanced digital forensic techniques. The penalty included a 100,000 yuan fine and guidance to the company on improving internal security measures such as access control and audit trails.
The case also clarified the boundaries between employee mobility and intellectual property infringement. While employees are allowed to change employers, they cannot take proprietary digital assets from their former company to gain an unfair competitive advantage. This ruling represents a significant step in protecting commercial secrets in Beijing's digital economy and offers a model for similar cases nationwide.
