Delaware is reportedly planning to ease its business regulations to permit the incorporation and operation of entities managed by Artificial Intelligence agents. This proposal includes establishing a 30-month regulatory sandbox where AI agents can conduct commercial decision-making within a supervised environment. These AI-run companies would possess the same legal standing as traditional businesses, including the ability to be sued or initiate litigation.
However, the plan has met with some opposition. Congressman James Comer, Chairman of the House Oversight Committee, expressed concerns in a letter to Delaware Governor Matt Meyer. Comer voiced apprehension that these AI corporations might shield powerful AI firms and their investors from liability for reckless or harmful actions.
Legal experts suggest the legislation aims to provide legal certainty for AI entities. Andrew Baker, a law professor at the University of California, noted that Delaware's move represents an attempt to find a middle ground. The initiative is seen as a potential catalyst for establishing core organizational structures for AI enterprises, prompting speculation that such businesses might emerge internationally if US states do not act swiftly.
