Oracle seeks legal protection as AI data center project faces delays

Oracle has issued a force majeure notice to Blue Owl Capital's STACK Infrastructure, which is developing the Project Jupiter AI data center in New Mexico. The move comes as investors question whether Oracle can deliver the necessary data center capacity to support its AI business expansion. The notice allows Oracle to pause certain contractual obligations due to unforeseen events impacting the project. Oracle's spokesperson, Michael Egburt, stated that such notices are common in large-scale projects and do not necessarily indicate delays or changes to delivery timelines. The company maintains its financial commitments to the multi-year project. Analysts, including RBC Capital Markets' Rish Jalluri, suggest the notice reflects increased internal concerns about project delays. Oracle has invested hundreds of billions in building new data centers to meet growing AI demand. Its first-quarter capital spending reached $28.5 billion, up from $8.5 billion a year earlier, with a forecast of $90 billion to $95 billion in capital expenditures for the 2027 fiscal year. Jalluri noted that delays in Project Jupiter could impact capacity delivery and revenue recognition by 2028.
