States explore regulations to control AI chatbots

States like Florida are beginning to test the limits of their ability to regulate AI chatbots such as ChatGPT. While a complete statewide shutdown of ChatGPT remains an extreme scenario, states already have the authority to control who can use AI, its functions, and where it can be deployed. Florida Attorney General James Uthmeier recently sought a temporary injunction against OpenAI and CEO Sam Altman, claiming the company cannot adequately self-regulate. States are not aiming to ban AI outright but are instead focusing on restricting its usage. They can regulate how companies operate within their borders through consumer-protection laws. OpenAI could respond by making nationwide changes or tailoring ChatGPT for Florida using location-based restrictions. Additionally, states are pushing for protections for minors, with OpenAI launching ChatGPT for Teens in August, creating a specialized AI environment for minors. States can also limit AI use in schools, courts, and public agencies. However, states do not have unlimited power over AI, as companies can challenge these restrictions in court, and federal law may override some state regulations.
